Cookies and right to object in the case of direct advertising

“Cookies” are small files that are stored on users’ computers. Various details can be stored within the cookies. A cookie primarily serves to store the details about a user (or the device on which the cookie is stored) during or also after their visit within an online service. Temporary cookies, or “session cookies” or “transient cookies”, are cookies which are deleted after a user leaves an online service and closes their browser. In such a cookie, for example, the contents of a shopping cart in an online shop or a login status may be stored. “Permanent” or “persistent” means cookies that remain stored even after closing the browser. Thus, for example, the login status can be stored if the users visit these again after several days. Likewise, in such a cookie the interests of the users may be stored, which are used for reach measurement or marketing purposes. “Third-party cookies” means cookies which are offered by providers other than the controller operating the online service (otherwise, if they are only its cookies, they are referred to as “first-party cookies”).

We can use temporary and permanent cookies and provide information about this within our privacy policy.

If users do not want cookies to be stored on their computer, they are asked to deactivate the corresponding option in the system settings of their browser. Stored cookies can be deleted in the system settings of the browser. The exclusion of cookies can lead to functional restrictions of this online service.

A general objection against the use of cookies used for online marketing purposes can be declared for a large number of services, especially in the case of tracking, via the US website http://www.aboutads.info/choices/ or the EU website http://www.youronlinechoices.com/. Furthermore the storage of cookies can be achieved by disabling them in the browser settings. Please note that then not all functions of this online service may be able to be used.

Deletion of data

The data processed by us are deleted or restricted in their processing in accordance with Articles 17 and 18 GDPR. Unless expressly stated within this privacy policy, the data stored with us are deleted as soon as they are no longer required for their purpose and the deletion is not prevented by any statutory retention obligations. If the data are not deleted because they are required for other and legally permissible purposes, their processing is restricted. This means the data are blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax law reasons.

According to legal requirements in Germany, retention takes place in particular for 10 years pursuant to Sections 147(1) AO, 257(1) no. 1 and 4, (4) HGB (books, records, management reports, accounting documents, commercial books, documents relevant for taxation, etc.) and 6 years pursuant to Section 257(1) no. 2 and 3, (4) HGB (commercial letters).

We process data that is necessary for establishing and performing the contractual services and point out the necessity of providing them. Disclosure to external parties only takes place if it is necessary within the framework of an order. GDPR in order to offer our users effective and secure payment options.

Among the data processed by the payment service providers are master data, such as the name and address, bank data, such as account numbers or credit card numbers, passwords, TANs and checksums as well as the contract-, amount- and recipient-related details. This means we receive no account- or credit-card-related information, but only information with confirmation or negative information about the payment. Under certain circumstances, the data may be transmitted by the payment service providers to credit agencies. This transmission is for the purpose of identity and creditworthiness checks. In this regard, we refer to the terms and conditions and privacy notices of the payment service providers.

For the payment transactions, the terms and conditions and the privacy notices of the respective payment service providers apply, which can be accessed within the respective websites or transaction applications. We also refer to these for the purpose of further information and assertion of withdrawal, access and other data subject rights.

Participation in affiliate partner programmes

Within our online service, we use industry-standard tracking measures on the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online service) pursuant to Article 6(1) (f) GDPR, insofar as these are necessary for the operation of the affiliate system. Below we inform the users about the technical background.

The services offered by our contractual partners can also be advertised and linked on other websites (so-called affiliate links or after-buy systems, if for example links or services of third parties are offered after a contract conclusion). The operators of the respective websites receive a commission if users follow the affiliate links and subsequently make use of the offers.

In summary, it is necessary for our online service that we can track whether users who are interested in affiliate links and/or the offers available from us subsequently take up the offers at the instigation of the affiliate links or our online platform. For this purpose, the affiliate links and our offers are supplemented by certain values, which can be a component of the link or otherwise, for example in a cookie, can be set. Among the values are in particular the originating website (referrer), time, an online identifier of the operators of the website on which the affiliate link was located, an online identifier of the respective offer, an online identifier of the user, as well as tracking-specific values such as e.g. advertising material ID, partner ID and categorizations.

In the case of the online identifiers of users used by us, these are pseudonymous values. This means the online identifiers themselves contain no personal data such as names or email addresses. They help us only to determine whether the same user who clicked on an affiliate link or was interested in an offer via our online service has taken up the offer, i.e. e.g. concluded a contract with the provider. However, the online identifier is personal to the extent that the partner company and also we, have the online identifier together with other user data. Only in this way can the partner company inform us whether that user has taken up the offer and we can e.g. pay out the bonus.

Amazon partner programme

We are on the basis of our legitimate interests (i.e. interest in the economic operation of our online service within the meaning of Article 6 (1)(f). GDPR) a participant in the partner programme of Amazon EU, which was designed to provide a medium for websites by means of which through the placement of advertisements and links to Amazon.de advertising cost reimbursement can be earned (so-called affiliate system). Amazon uses cookies in order to be able to trace the origin of orders. Among other things, Amazon can recognise that you clicked the partner link on this website and subsequently purchased a product from Amazon.

Further information on data use by Amazon and options to object can be found in the company’s privacy policy.

Contact

When contacting us (e.g. via contact form, email, telephone or via social media), the user’s details for handling the contact enquiry and its processing are processed pursuant to Article 6(1)(b) GDPR. The users’ details can be stored in a customer relationship management system ("CRM system") or comparable enquiry organisation.

We delete the enquiries if they are no longer required. We review the necessity every two years; Furthermore, the statutory archiving obligations apply.

Newsletter

With the following information we inform you about the contents of our newsletter as well as the registration, dispatch and the statistical evaluation procedure and your rights to object. By subscribing to our newsletter, you agree to receiving it and to the described procedures.

Content of the newsletter: We send newsletters, emails and other electronic notifications with promotional information (hereinafter “newsletter”) only with the consent of the recipients or a legal permission. If in the context of a registration for the newsletter its contents are specifically described, they are decisive for the consent of the users. In all other respects our newsletters contain information about our services and us Double-Opt-In and logging: Registration for our newsletter takes place in a so-called double-opt-in procedure. This means you receive after registration an email in which you are asked to confirm your registration. This confirmation is necessary so that nobody can register with third-party email addresses. The registrations for the newsletter are logged in order to be able to prove the registration process in accordance with legal requirements. This includes the storage of the registration and confirmation time, as well as the IP address. Likewise changes to your data stored with the dispatch service provider are logged.

Registration data: To register for the newsletter it is sufficient if you provide your email address. Optionally we ask you to provide a name for the purpose of personal salutation in the newsletter.

The dispatch of the newsletter and the success measurement associated with it take place on the basis of consent of the recipients pursuant to Article 6(1)(a), Article 7 GDPR in conjunction with Section 7(2) No. 3 UWG or if consent is not required, on the basis of our legitimate interests in direct marketing pursuant to Article 6 (1) lit. f. GDPR in conjunction with Section 7(3) UWG.

The logging of the registration procedure takes place on the basis of our legitimate interests pursuant to Article 6(1)(f) GDPR. Our interest is directed towards the use of a user-friendly and secure newsletter system, which both serves our business interests, as well as corresponds to the expectations of users and furthermore allows us to provide proof of consent.

Cancellation/Withdrawal - You can cancel the receipt of our newsletter at any time, i.e. revoke your consent. A link to cancel the newsletter can be found at the end of every newsletter. We can store the unsubscribed email addresses for up to three years on the basis of our legitimate interests before we delete them, in order to be able to prove previously given consent. The processing of these data is restricted to the purpose of a possible defence against claims. An individual deletion request is possible at any time, provided that at the same time the former existence of consent is confirmed.

Newsletter - Success measurement

The newsletters contain a so-called “web beacon”, i.e. a pixel-sized file that is retrieved when the newsletter is opened from our server, or if we use a dispatch service provider, from its server. Within the framework of this retrieval, technical information, such as information on the browser and your system, as well as your IP address and time of retrieval are initially collected.

These information are used for the technical improvement of the services on the basis of the technical data or the target groups and their reading behaviour on the basis of the retrieval locations (which can be determined with the help of the IP address) or the access times used. Statistical surveys also include the determination of whether the newsletters are opened, when they are opened and which links are clicked. These information can for technical reasons indeed be assigned to the individual newsletter recipients. However, it is neither our endeavour, nor, if used, that of the dispatch service provider, to observe individual users. The evaluations serve us much more to recognise the reading habits of our users and to adapt our contents to them or to send different contents according to the interests of our users.

Hosting

The hosting services used by us serve to provide the following services: infrastructure and platform services, computing capacity, storage space and database services, security services as well as technical maintenance services, which we use for the purpose of operating this online service.

In this context, we or our hosting provider process master data, contact data, content data, contract data, usage data, meta and communication data of customers, prospective customers and visitors to this online service on the basis of our legitimate interests in an efficient and secure provision of this online service pursuant to Article 6(1)(f) GDPR in conjunction with Article 28 GDPR (conclusion data processing agreement).

Google Analytics

We use on the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online service within the meaning of Article 6(1)(f). GDPR) Google Analytics, a web analytics service of Google LLC (“Google”). Google uses cookies. The information generated by the cookie about use of the online service by the users is generally transmitted to a server of Google in the USA and stored there.

Google is certified under the Privacy Shield Agreement and thereby provides a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

Google will use this information on our behalf to evaluate the use of our online service by the users, to compile reports on the activities within this online service and to provide us with further services related to the use of this online service and the internet use. In doing so, pseudonymous usage profiles of the users can be created from the processed data.

We use Google Analytics only with activated IP anonymisation. This means the IP address of the users is truncated by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a server of Google in the USA and truncated there.

The IP address transmitted by the user’s browser is not merged with other data of Google. The users can prevent the storage of cookies by a corresponding setting of their browser software; the users can furthermore prevent the collection of the data generated by the cookie and relating to their use of the online service to Google as well as the processing of these data by Google, by downloading and installing the under the following link available browser plugin: http://tools.google.com/dlpage/gaoptout?hl=de.

Further information on data use by Google, settings and options to object, can be found in the privacy policy of Google (https://policies.google.com/technologies/ads) as well as in the settings for the display of advertising by Google (https://adssettings.google.com/authenticated).

The personal data of users are deleted or anonymised after 14 months.

Google AdWords and conversion measurement

We use on the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online service within the meaning of Article 6(1)(f). GDPR) the services of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, (“Google”).

Google is certified under the Privacy Shield Agreement and thereby provides a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

We use the online marketing procedure Google "AdWords" in order to place advertisements in the Google advertising network (e.g., in search results, in videos, on websites, etc.), so that they are shown to users who have a presumed interest in the advertisements. This allows us to display advertisements for and within our online service in a more targeted manner, in order to present users only with advertisements that potentially correspond to their interests. If a user e.g. is shown advertisements for products in which they have shown interest on other online services, this is referred to as “remarketing”. For these purposes, when our and other websites on which the Google advertising network is active are accessed, immediately by Google a code from Google is executed and so-called (re)marketing tags (invisible graphics or code, also referred to as "web beacons") are integrated into the website. With their help, an individual cookie, i.e. a small file, is stored on the device of the users (instead of cookies comparable technologies can also be used). In this file it is noted which websites the user has visited, for which contents they are interested and which offers the user clicked, furthermore technical information on the browser and operating system, referring websites, visit time as well as further details on the use of the online service.

Furthermore, we receive an individual “conversion cookie”. The information obtained with the help of the cookie serves Google to create conversion statistics for us. However, we only learn the anonymous total number of the users who clicked on our advertisement and were redirected to a page provided with a conversion tracking tag. We do not however receive any information with which users can be personally identified.

The data of users are processed within the Google advertising network pseudonymously. This means Google stores and processes e.g. not the name or email address of users, but processes the relevant data cookie-related within pseudonymous user profiles. This means from the point of view of Google the advertisements are not managed and displayed for a specifically identified person, but for the cookie holder, regardless of who this cookie holder is. This does not apply if a user has expressly allowed Google to process the data without this pseudonymisation. The information collected about the users is transmitted to Google and stored on Google’s servers in the USA.

Further information on data use by Google, settings and options to object, can be found in the privacy policy of Google (https://policies.google.com/technologies/ads) as well as in the settings for the display of advertisements by Google (https://adssettings.google.com/authenticated).

Facebook pixel, Custom Audiences and Facebook conversion

Within our online service, due to our legitimate interests in analysis, optimisation and economic operation of our online service and for these purposes the so-called "Facebook pixel" of the social network Facebook, which is operated by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA, or if you are resident in the EU, Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook"), is used.

Facebook is certified under the Privacy Shield Agreement and thereby provides a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt0000000GnywAAC&status=Active).

With the help of the Facebook pixel, Facebook is on the one hand able to determine the visitors to our online service as a target group for the display of advertisements (so-called "Facebook Ads"). Accordingly, we use the Facebook pixel in order to show the Facebook Ads placed by us only to such Facebook users who have also shown an interest in our online service or who have certain characteristics (e.g. interests in certain topics or products, which are determined on the basis of the visited websites ) that we transmit to Facebook (so-called “Custom Audiences”). With the help of the Facebook pixel we also want to ensure that our Facebook Ads correspond to the potential interest of the users and do not appear harassing. With the help of the Facebook pixel we can furthermore trace the effectiveness of the Facebook advertisements for statistical and market research purposes by seeing whether users after clicking on a Facebook advertisement were redirected to our website (so-called “conversion”).

The processing of data by Facebook takes place within the framework of Facebook’s data usage policy. Accordingly general information on the display of Facebook Ads, in the data usage policy of Facebook: https://www.facebook.com/policy.php. Special information and details on the Facebook pixel and its functionality can be found in the Facebook Help Centre.

You may object to the collection by the Facebook pixel and use of your data for the display of Facebook Ads. To determine which types of advertisements are shown to you within Facebook, you can visit the page set up by Facebook and follow the instructions on the settings of usage-based advertising there: https://www.facebook.com/settings?tab=ads. The settings are platform-independent, i.e. they are applied for all devices, such as desktop computers or mobile devices.

You can also object to the use of cookies that serve reach measurement and advertising purposes, furthermore via the deactivation page of the network advertising initiative (http://optout.networkadvertising.org/) and in addition the US website (http://www.aboutads.info/choices) or the European website (http://www.youronlinechoices.com/uk/your-ad-choices/).

Online presences in social media

We maintain online presences within social networks and platforms in order to communicate with the customers, prospective customers and users active there and to be able to inform them there about our services. When accessing the respective networks and platforms, the terms and conditions and the data processing guidelines of their respective operators apply.

Unless otherwise within our privacy policy indicated, we process the data of the users if they communicate with us within the social networks and platforms, e.g. write posts on our online presences or send us messages.

Integration of services and content of third parties

We use within our online service on the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online service within the meaning of Article 6 (1)(f). GDPR) content or service offers of third-party providers in order to integrate their content and services, such as videos or fonts (hereinafter uniformly referred to as “content”).

This always presupposes that the third-party providers of this content perceive the IP address of the users, since without the IP address they would not be able to send the content to their browser. The IP address is therefore required for the display of this content. We endeavour to use only such content whose respective providers use the IP address merely for the delivery of the content. Third-party providers can furthermore use so- called pixel tags (invisible graphics, also referred to as "web beacons") for statistical or marketing purposes. Through the "pixel tags" information such as visitor traffic on the pages of this website can be evaluated. The pseudonymous information can furthermore be stored in cookies on the device of the users and contain, among other things, technical information on the browser and operating system, referring websites, visit time as well as further details on the use of our online service, and also be linked with such information from other sources.

Google Fonts

We integrate the fonts ("Google Fonts") of the provider Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Privacy policy: https://www.google.com/policies/privacy/, opt-out: https://adssettings.google.com/authenticated.

Google Maps

We integrate the maps of the service “Google Maps” of the provider Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Among the processed data may in particular include IP addresses and location data of users, which however are not collected without their consent (usually carried out within the framework of the settings of their mobile devices ). The data can be processed in the USA. Privacy policy: https://www.google.com/policies/privacy/, opt-out: https://adssettings.google.com/authenticated.

Use of Facebook social plugins

We use on the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online service within the meaning of Article 6(1)(f). GDPR) social plugins ("plugins") of the social network facebook.com, which is operated by the Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook"). The plugins can display interaction elements or content (e.g. videos, graphics or text posts) and are recognisable by one of the Facebook logos (white “f” on blue tile, the terms "Like", "Gefällt mir" or a “thumbs up” sign) or are marked with the addition "Facebook Social Plugin". The list and appearance of the Facebook Social Plugins can be viewed here: https://developers.facebook.com/docs/plugins/.

Facebook is under the Privacy Shield Agreement certified and thereby provides a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt0000000GnywAAC&status=Active).

If a user accesses a function of this online service that contains such a plugin, their device establishes a direct connection with the servers of Facebook. The content of the plugin is transmitted by Facebook directly to the device of the user and integrated by this into the online service. In doing so, user profiles can be created from the processed data. We therefore have no influence on the extent of the data that Facebook collects with the help of this plugin and therefore inform the users accordingly to our state of knowledge.

Through the integration of the plugins Facebook receives the information that a user has accessed the corresponding page of the online service. If the user is logged in to Facebook, Facebook can assign the visit to their Facebook account. If users interact with the plugins, for example press the Like button or submit a comment, the corresponding information is transmitted from your device directly to Facebook and stored there. If a user is not a member of Facebook, there is nevertheless the possibility that Facebook learns and stores their IP address. According to Facebook, only an anonymised IP address is stored in Germany.

Purpose and extent of data collection and the further processing and use of the data by Facebook as well as the rights and settings options relating thereto for protecting the privacy of users, can be found by them in the privacy notices of Facebook: https://www.facebook.com/about/privacy/.

If a user is a Facebook member and does not want Facebook to collect data about them via this online service and link it with their member data stored at Facebook, they must log out of Facebook before using our online service and delete their cookies. Further settings and objections to the use of data for advertising purposes are possible within the Facebook profile settings: https://www.facebook.com/settings?tab=ads  or via the US website http://www.aboutads.info/choices/  or the EU website http://www.youronlinechoices.com/. The settings take place platform-independently, i.e. they are applied for all devices, such as desktop computers or mobile devices.
